Private School Football Team Involved in Fatal Bus Accident

Private School Football Team Involved in Fatal Bus Accident

October 21, 2016 by • Bus Accident •

Just days ago Ramah Juco Academy loaded up their football team and was on their way to one of the first games of the season, against University of God’s Chosen in Raeford NC, when tragedy struck.  An eight-year-old boy is among the four dead in this fatal bus accident on I-74 near Rockingham, NC.  This tremendous loss of life is devastating.

The driver, Brian Kilpatrick, 21-year-old Devonte Gibson, and 19-year-old Teto Hamilton were also killed in the accident.

busThe crash occurred near mile marker 316 in Richmond County.  After many hours of being closed US-74 finally reopened around midnight.  Forty-six people were on the bus when it crashed according to Lieutenant Jeff Gordan with NC Highway Patrol.  Outside of the four fatalities everyone else was sent to area hospitals with injuries ranging from mild too critical.  Three students were flown to other hospitals due to more serious injuries.  Only one person who was transported to the hospital sustained no injuries.

“I’ve been this job for 23 years now. I’ve seen my fair share and this is one of the worst, especially when you have a group of students, young people just starting their lives, going to a football game.” Gordan said.

Eight people remain in serious condition following the accident, and 22 have been released from area hospitals.  Tyreak Thompson is one of the football players that have been released.  He said he was dozing, and remembers the bus hitting the railing in the median.

“I was half asleep, then when I opened my eyes, we had hit the rail, and that’s all I remember.” Thompson said.

The driver was from Chester SC. The other victims Devonte Gibson and Darice Hicks were from Rock Hill and Teto Hamilton is from Pahokee Fl.

Mychal Frost issued a statement on behalf of Rock Hill Schools, “Our thoughts and prayers are with the Hicks family and all other families impacted by this tragedy.” Darice Hicks was a third grader at Ebenezer Avenue Elementary School in Rock Hill. bus_crash_rear-22605436_std

Troopers on the scene believe a blown out front tire caused the driver to lose control of the bus and crash into the median.

“Accidents like this are senseless and the loss of life, especially young people’s lives, are so very tragic.  This is why equipment carrying our precious students’ needs to be consistently evaluated to prevent horrific accidents like this one.”  said Joe Sandefur, managing partner of a top personal injury firm in Florida at johnbales.com.

Four people lost their lives because of an over worn tire that more than likely needed to be replaced.  Before loading up our students for sporting events or field trips these buses need to be check over for any sign of a problem.  School staff and students are much too precious to put on the road with faulty equipment and risk their lives.

Florida Laws Regarding Drugs

Florida Laws Regarding Drugs

July 14, 2016 by • Drugs, Florida Laws, Law •

Florida’s drug laws are the various strictest within the country. Mere ownership of a managed substance including cocaine, heroin, or methamphetamine is a 3rd degree prison, that could carry penalties which includes fines and up to five years in jail. if you are currently dealing with possession costs, but, you aren’t without prison defenses.

Real possession
1440023039206Florida law acknowledges two varieties of drug ownership – real and optimistic. Actual possession is when police find a drug virtually to your person, for example, in a jacket pocket. Whether you technically own the drug is legally inappropriate. As an example, if you borrowed a chum’s jacket that had cocaine in the pocket, the truth that it changed into not your cocaine isn’t a defense.

Possession costs
The exceptional manner to undertaking and real ownership price is to name into query the forestall and seek that resulted in the police locating the drugs. An officer should have an inexpensive suspicion which you have devoted, or are about to commit, a criminal offense on the way to legally stop you. (See Fl. Stat. §901.151.) An affordable suspicion requires a foundation in truth considering all of the occasions of a stop; the officer might not depend genuinely on a hunch. Thereafter, an officer need to have probable cause to guide a search. Possibly reason is a higher felony widespread than reasonable suspicion. If the officer lacked reasonable suspicion to forestall you or probable cause to behavior a search, then the charges against you must be dismissed.

Constructive Ownership
In case you are charged with possession of medicine without a prescription from a doctor, that is located in every other region or a not unusual place, the prosecution should prove optimistic possession, which means which you knew the drugs were there and you had the capacity to get right of entry to or manage them. You might be charged with optimistic possession in case you had been a passenger in a vehicle when police located pills in the glove compartment. The prosecution need to set up that:

You had intention and manage over the medicine;
You knew that the drugs have been there;
You knew that the drugs had been unlawful. (See Williams v. nation, 573 So. 2d 124 (Fla. Dist. Ct. App. 1991.)

The fact that the drugs have been found near you is not enough to demonstrate constructive possession, despite the fact that they have been in plain view. for example, in Williams v. country, referenced above, the defendant Williams turned into arrested after a search of the chair he become sitting in out of doors a pool corridor became up three cocaine rocks beneath the cushion and at the floor below it. Williams changed into surrounded by way of a collection of six to ten other guys on the same time. The court docket dominated that the proof changed into inadequate to prove that Williams knew the cocaine become there or had manipulate over it.

These were only few laws on topics of drug possession and distribution.
